This document is a draft that is still being reviewed by our lawyers. Company details marked MISSING will be filled in before launch.

These Terms of Service ("Terms") govern your use of email-validation.org, operated by Inbox Perfection LLC, 16192 Coastal Hwy, Lewes, DE 19958, US ("we", "us"). By creating an account or buying credits you agree to these Terms, the [Acceptable Use Policy](https://email-validation.org/legal/acceptable-use/) and the [Data Processing Agreement](https://email-validation.org/legal/dpa/).

## Who may use the service

The service is for business and professional use. When you create an account or buy credits, you confirm that you act for a business, a profession or another organisation, and that you are authorised to accept these Terms for it. Packs are not sold to consumers.

## Your account

- You sign in with a one-time code sent to your email, with Google, or with a passkey. Keep access to your email address and devices secure; you are responsible for activity on your account and its API keys.
- Keep API keys secret. Send them only in the Authorization header. Revoke a key at once if you think it has leaked.
- One person or organisation may hold one account for free credits. Creating extra accounts to collect free credits is not allowed.

## Credits

- One credit pays for one validated address. A result with the status unknown is free, and so are requests that fail with an error, addresses rejected as malformed before any check, and test addresses on our sandbox domain.
- New accounts receive 500 free credits once, subject to the checks described on the sign-up page.
- Credits are sold in one-time packs at the prices shown on the [pricing page](https://email-validation.org/pricing/) when you buy. Prices in USD, excluding tax. VAT or sales tax is added at checkout where applicable.
- Each of your first 3 completed payments adds a bonus of 15% of the pack's credits, for any payment method. A payment card can earn the bonus on at most 3 payments across all accounts.
- Every credit, whether free, bonus or purchased, expires 24 months after it was granted. We always spend the credits that expire soonest first.
- Credits have no cash value, cannot be transferred to another account and are not refundable, except where the law requires otherwise.

## Payments and refunds

Payments are processed by Stripe. Purchases are final: we do not refund credits, used or unused. This does not affect any statutory rights you may have. See the [Refund Policy](https://email-validation.org/legal/refunds/).

## Using the API

- Accounts that have made a purchase can send up to 500 validation requests per second; before the first purchase the limit is 20 per second. We may lower limits temporarily to protect the service.
- Each check waits at most 15 seconds for the receiving mail server. Slower checks return unknown and are not charged.
- Bulk lists may have up to 1,000,000 rows. Uploaded files and results are deleted 30 days after upload (results of a list that finishes in its last day are kept for 7 days after it finishes).

## What a result means

A validation result is our best assessment at the moment of the check. Mail servers change, and some refuse to confirm mailboxes. We do not guarantee that a message sent to a deliverable address will arrive, or that a risky or undeliverable result is permanent.

## Acceptable use

You must follow the [Acceptable Use Policy](https://email-validation.org/legal/acceptable-use/). We may throttle, suspend or close an account that breaks it, and we may keep credits that were used in breach of it.

## Personal data

When you submit addresses for checking, you are the controller of that data and we process it for you under the [Data Processing Agreement](https://email-validation.org/legal/dpa/). How we handle your own account data is described in the [Privacy Policy](https://email-validation.org/legal/privacy/).

## Support

Support is provided by an AI assistant by email and chat. It answers from our documentation and policies and cannot see or change your account. Privacy, abuse, legal and security requests sent to their own addresses are reviewed by a person.

## Availability and changes

We work to keep the service available but do not promise uninterrupted operation. We may change features, limits or prices; price changes never affect credits you already hold. We announce material changes to these Terms on the [changelog](https://email-validation.org/changelog/) and by email at least 30 days before they take effect.

## Liability

To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses, lost profits or lost data. Nothing in these Terms limits liability that cannot be limited by law.

## Ending the agreement

You may delete your account at any time in your settings. Unused credits lapse when the account is deleted. We may end or suspend the service for breach of these Terms, with notice where practicable.

## Governing law

These Terms are governed by the laws of State of Delaware. Questions about these Terms go to [legal@email-validation.org](mailto:legal@email-validation.org).
